Functional limitations can severely impact a person’s ability to manage his/her own financial and personal affairs. Usually resulting from cognitive impairment, financial abuse or personal neglect, functional limitations can result in harm to the individual. Many fail to have proper advance directives such as a power of attorney or health care proxy. The appointment of a guardian through a guardianship proceeding is often the only recourse one may have to assist a person in need. We will discuss when to consider applying for the appointment of a guardian and provide a general overview of the guardianship process.
